Application
Application 1: 
Requirement for fire separation of a floor assembly, including a floor over a basement, that is entirely contained within a dwelling unit that has more than one storey and that is located within a storey in which more than 10% of the area is classified as a Group C major occupancy. This applies in buildings that:
This applies to buildings to which Part 3 applies [see Sentence 1.3.3.2.(1) of Division A for application of Part 3].
Exceptions: 
except:
  • a storey in which more than 10% of the area is classified as a Group C major occupancy but the building complies with the conditions of Articles 3.2.2.45., 3.2.2.46., 3.2.2.47. or 3.2.2.48.,
  • a storey in which more than 10% of the area is classified as a Group C major occupancy but in addition has more than 10% of the area classified as a major occupancy that has more stringent requirements in accordance with Articles 3.2.2.20. to 3.2.2.43. and 3.2.2.45. to 3.2.2.83.,
  • a storey in which more than 10% of the area is classified as a Group C major occupancy but also has a portion of its floor area used for a Group F, Division 1 or 2 occupancy, and
  • as provided in Sentence 3.3.4.2.(3), which waives the requirement for floor assemblies within dwelling units to be fire separations, under certain conditions.

Intent
Intent 1: 
To exempt a floor assembly, including a floor over a basement, which is entirely contained within a dwelling unit, from the requirement of Clause 3.2.2.44.(2)(a) that it be a fire separation.
