Application
Application 1: 
Covered ways to protect the public, where construction may constitute a hazard to the public.
Exceptions: 
except where:
  • the work is done within a solid enclosure,
  • the building is at a distance of 2 m or more from a public way used by pedestrians, or
  • site conditions warrant a distance greater than provided in Clause 8.2.1.1.(1)(b).
This applies to sites where buildings are undergoing construction, alteration or repair, including any incomplete or abandoned buildings.

Intent
Intent 1: 
To waive the need for a covered way to protect the public if certain conditions are met:
  • the work is undertaken within a solid enclosure so that persons are not exposed to a hazard, or
  • the work is sufficiently set back from a public way to minimize the hazard to persons using the public way.
