Application
Application 1: 
Openable windows, in buildings of residential occupancy to which Part 9 applies [see Sentence 1.3.3.3.(1) of Division A for application of Part 9].
Exceptions: 
except as stated in Sentence 9.7.1.5.(2), which applies to:
  • windows that serve dwelling units that are not located above another suite,
  • windows in which the only opening greater than 100 mm by 380 mm is a horizontal opening at the top of the window,
  • windows whose sill is located more than 450 mm above the finished floor on one side of the window, and
  • windows that are located in rooms or spaces where the finished floor described in Clause (c) is located less than 1 800 mm above the floor or ground on the other side of the window.

Intent
Intent 1: 
To limit the probability that inadequate fall protection, particularly for children and infants, will lead to falls from a significant height through open windows, which could lead to harm to persons.
Intent 2: 
To expand the application of Section 9.8. to include guards for windows.
