Application 1: 
Maximum size of openings in guards required by Article 9.8.8.1. [see Sentence 9.8.8.1.(1) for locations of required guards], in buildings to which Part 9 applies [see Sentence 1.3.3.3.(1) of Division A for application of Part 9].
Exceptions: 
except:
  • where it can be shown that the location and size of openings that do not comply with these limits do not represent a hazard,
  • as stated in Sentence 9.8.8.5.(2), which applies to buildings of industrial occupancy, and
  • as stated in Clause 3.8.3.4.(1)(e), which applies to barrier-free design in buildings described in Sentence 3.8.1.1.(1) [see Sentence 9.5.2.1.(1)].
Application 2: 
This also applies to guards within dwelling units in buildings to which Part 3 applies [see Sentence 1.3.3.2.(1) of Division A for application of Part 3], as stated in Sentence 3.3.4.7.(1).

Intent
Intent 1: 
To limit the probability of excessively large openings in guards, which could lead to small children falling through the guards or having their head lodged between guard elements, which could lead to harm to persons.
Intent 2: 
In cases where a less stringent requirement is not specifically stated, to limit the probability of excessively large openings in guards, which could lead to adults falling through the guards, which could lead to harm to persons.
