Application
Application 1: 
Rectangular masonry or concrete chimneys, in buildings to which Part 9 applies [see Sentence 1.3.3.3.(1) of Division A for application of Part 9], that:
  • are more than 12 m in height, or
  • serve appliances having a combined total rated heat output of more than 120 kW [see Clause 9.21.1.1.(1)(a)].
Application 2: 
This also applies to chimneys, in buildings to which Part 9 applies [see Sentence 1.3.3.3.(1) of Division A for application of Part 9], that are:
  • other than rectangular, or
  • other than of masonry or concrete [see Clause 9.21.1.1.(1)(a)].
Exceptions: 
except for factory-built chimneys covered by the standards referenced in Subsection 9.33.10. and serving gas-, oil- or solid-fuel-burning appliances covered by the standards referenced in Sentences 9.33.5.2.(1) and 9.33.5.3.(1) [see Sentence 9.21.1.1.(2)].
Application 3: 
This also applies to flue pipes, in buildings to which Part 9 applies [see Sentence 1.3.3.3.(1) of Division A for application of Part 9]:
  • other than those connected to chimneys described in Sentence 9.21.1.1.(1) [i.e. rectangular masonry or concrete chimneys not more than 12 m in height serving fireplaces or appliances having a combined total rated heat output of 120 kW or less], or
  • other than those described in Sentence 9.21.1.1.(2) [i.e. serving gas-, oil- or solid-fuel-burning appliances that are covered by the standards referenced in Sentences 9.33.5.2.(1) and 9.33.5.3.(1)].
